1. Acceptance

By registering for, accessing or using Naranest (the "Service"), you accept these Terms and Conditions (the "Terms") and our Privacy Policy. If you do not agree, you must not use the Service. The controller of the Service is Juan Raimundo Martín Gutiérrez (the "Controller" or "we").

2. Description of the Service

Naranest is an application that allows users to record and view information related to baby care (feeding, sleep, nappies, activities, weight and height measurements, etc.), generate reports and, where applicable, share access with other carers. The Service is provided "as is" and may include free and paid plans as published on the website.

Important: The Service is for informational and organisational support only. We are not healthcare professionals and do not replace consultation with a paediatrician or doctor. Always see the Important notice (Disclaimer).

3. Registration and account

To use the Service you must register (e.g. via Google sign-in). You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity from your account. You must notify us immediately of any unauthorised use.

4. Acceptable use

You agree to use the Service lawfully and in accordance with these Terms. In particular, you must not:

• Use the Service for illegal or unauthorised purposes.
• Impersonate others or falsify your identity.
• Attempt to access systems, data or accounts of others without authorisation.
• Introduce viruses, malware or take actions that damage or overload the Service.
• Circumvent technical or usage restrictions (plan limits, etc.) fraudulently.
• Resell, sublicense or commercially exploit the Service without express authorisation.

Breach of these obligations may result in suspension or termination of your account and, where applicable, legal action.

5. Plans, pricing and payments

Current plans and prices are published on the Plans page and form part of these Terms. For information, as of the last update date the Service offers:

• Free plan: 1 baby, 1 carer; basic records and calendar. Limits on number of measurements as published.
• Pro plan (paid): multi-user (multiple carers per baby), multi-baby, exports, paediatric report, advanced statistics. Offered as monthly subscription (€4.99/month), annual subscription (€34.99/year) or one-off lifetime payment (permanent access for a single price, as published). Prices are shown on the website and may include VAT where applicable.

Payments are processed via Stripe (payment gateway). By starting a payment or subscription you accept Stripe's terms and our Privacy Policy. Recurring charges (monthly or annual) renew automatically until you cancel from your account or the Stripe dashboard. You can set cancellation at the end of the current period (no further billing). One-off (lifetime) payment does not renew.

Cancellations and refunds: Cancelling a subscription stops future charges; it does not by itself entitle you to a refund of already billed periods. In specific cases (billing error, plan change with prorating, or withdrawal rights where the law so provides) we may apply refunds or credits in accordance with our policy and consumer law. For payment disputes you may contact Stripe and legal complaint channels (consumer, arbitration, etc.).

No resale or unauthorised commercial use: Access to the Service is personal and non-transferable. Resale, sublicensing, redistribution or commercial exploitation of the Service or its content without the Controller's express authorisation is prohibited.

6. Intellectual property

The Service, its design, trademarks, code and proprietary content are the property of the Controller or its licensors. You are granted a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You acquire no rights in the Controller's intellectual property. Data you enter (records, baby names, etc.) remains yours; you grant us the licence necessary to provide the Service (store, display, generate reports, share with users you invite).

7. Disclaimer and limitation of liability

The Service is provided "as is" and "as available". To the extent permitted by applicable law, the Controller does not guarantee that the Service will be uninterrupted, error-free or meet specific requirements other than those described. We shall not be liable for indirect, consequential, lost profit or special damages, or for loss of data arising from use or inability to use the Service. Our total liability for any cause shall be limited to the amount you actually paid in the twelve months before the event giving rise to the claim, or to the amount set by law as a mandatory limit.

You are responsible for how you use the information and reports generated. The Service does not constitute medical, paediatric or health advice; always consult a healthcare professional.

8. Termination and cancellation

You may close your account at any time from the application settings or by contacting us. We may suspend or terminate access to the Service if you breach these Terms or for technical or legal reasons, with such notice as the law requires where applicable. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (limitation of liability, governing law, etc.) shall remain in force.

9. Modifications

We may modify these Terms. Material changes will be notified by a notice on the Site or by email when required by law. Continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree, you must stop using the Service and, where applicable, cancel your account.

10. Governing law and jurisdiction

These Terms are governed by Spanish law. For consumers, the protective rules of your country of residence that cannot be waived shall apply. The parties submit to the courts of the consumer's place of residence or those determined by law.
